These Terms of Service ("Terms") govern your access to and use of Rawback (the "Service"), a photo platform operated by us ("Rawback", "we", "us"). By creating an account or using the Service, you agree to these Terms. Please read them carefully.
1. Eligibility
You must be at least 13 years old (or the equivalent minimum age in your jurisdiction) to use Rawback. By using the Service, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.
2. Your Account
You are responsible for the activity that happens under your account, including for keeping your credentials secure. Notify us promptly at [email protected] if you suspect unauthorized access. You agree to provide accurate information when registering and to keep it up to date.
3. Your Content
You retain ownership of the photos, videos, metadata, and other content you upload to Rawback ("Your Content"). You grant Rawback a worldwide, non-exclusive, royalty-free license to host, store, reproduce, transmit, transcode, display, and create derivatives of Your Content solely to operate, secure, and improve the Service for you and the people you share with. This license ends when you delete Your Content or close your account, except for backups still rotating out of our systems and copies others have already legitimately accessed through your shares.
You are responsible for Your Content. You represent that you own it or have all necessary rights, and that uploading and sharing it through Rawback does not violate any law or third-party right.
4. Acceptable Use
You agree not to:
- Upload, store, or share content that is illegal, infringing, defamatory, or that depicts the sexual exploitation of minors.
- Upload content that contains malware or that is designed to disrupt or compromise the Service or other users.
- Attempt to gain unauthorized access to accounts, infrastructure, or data; probe or scan for vulnerabilities outside the scope of a published security program; or interfere with the normal operation of the Service.
- Use the Service to send spam, harass others, or violate applicable privacy laws.
- Reverse engineer, scrape at scale, or use automated means to access the Service in ways that are not supported by our official APIs.
- Resell, sublicense, or otherwise commercially exploit the Service except as expressly permitted by us.
We may suspend or terminate accounts that violate this section, and we may report illegal activity to the relevant authorities.
5. AI Features
Rawback offers AI-powered features such as automatic tagging, scene recognition, similarity search, and face grouping. These features rely on machine learning models and may produce inaccurate or unexpected results. You are responsible for reviewing AI output before relying on it. We do not use Your Content to train foundation models that we publish to third parties.
6. Subscriptions, Credits, and Billing
Some features require a paid subscription or consumable credits. Pricing, included quotas, and feature availability for each tier are described on our pricing page and may change with notice. Subscription fees are charged in advance for the billing period you select and are non-refundable except where required by law. You can cancel a subscription at any time from your account settings; cancellation takes effect at the end of the current billing period and your account reverts to the free tier thereafter.
7. Third-Party Services
The Service integrates with third-party providers (for example, sign-in providers and payment processors). Your use of those services is governed by their own terms and privacy policies. We are not responsible for the practices of third parties.
8. Termination
You may close your account at any time from your settings. We may suspend or terminate your access if you breach these Terms, if we are required to do so by law, or if continued operation of your account creates a risk to Rawback or other users. On termination, your right to use the Service ends and we will delete or anonymize your data as described in our Privacy Policy. Sections that by their nature should survive termination (including content licenses to copies others have already accessed, disclaimers, and limitations of liability) will survive.
9. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any data will be preserved without loss. You are responsible for maintaining your own backups of irreplaceable content.
10. Limitation of Liability
To the maximum extent permitted by law, Rawback and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim arising out of or related to these Terms or the Service is limited to the amount you paid us in the twelve months preceding the claim, or USD 100 if you have not paid us anything.
11. Indemnification
You agree to defend, indemnify, and hold harmless Rawback and its affiliates from any claim, damage, or expense (including reasonable legal fees) arising out of Your Content, your breach of these Terms, or your violation of any law or third-party right.
12. Changes to the Service or These Terms
We may modify or discontinue features of the Service at any time. We may also update these Terms; when we make material changes we will update the date above and, where appropriate, notify you through the product or by email. If you continue to use the Service after the changes take effect, you accept the updated Terms. If you disagree with the changes, you should stop using the Service and may close your account.
13. Governing Law
These Terms are governed by the laws of the jurisdiction in which Rawback is established, without regard to its conflict of laws provisions. Any dispute arising out of or related to these Terms or the Service that cannot be resolved informally will be submitted to the competent courts of that jurisdiction.
